General Terms and Conditions of Sale and Use


ARTICLE 1 – SCOPE

These General Terms and Conditions of Sale (hereinafter "GTC") govern all sales concluded between the company "RECONVERTEUR" (hereinafter referred to as the "Company") and individuals acting as consumers for personal use (hereinafter referred to as the "Client") via the website https://reconverteur.com, where RECONVERTEUR offers for sale second-hand and refurbished electronic devices, possibly accompanied by compatible accessories (hereinafter referred to as the "Product(s)").

The GTC apply exclusively, to the exclusion of any other condition, and are available at any time on the website under the "G.T.C." section. They shall prevail, if applicable, over any other version or document.

Unless proven otherwise, the data recorded by the Company shall be deemed conclusive for all transactions.

In any case, the online provision of the credit card number and the final validation of the order constitute proof of the entirety of said order in accordance with Article 1366 of the Civil Code, and render the amounts engaged by the entry of the Products listed on the order form due.

This validation serves as a signature and express acceptance of all operations performed on the Website.

The computerized records, kept in the computer systems of the Company and its partners under reasonable security conditions, will be considered as proof of communications, orders, and payments made between the Client and the Company.

The archiving of order forms and invoices is carried out on a reliable and durable medium, ensuring a faithful and lasting copy in accordance with Article 1379 of the Civil Code.

The Company reserves the right, at its sole discretion, to modify the GTC at any time.
In the event of modification of the GTC, the applicable GTC for the sale will be those in effect at the time of validation of the purchase by the Client on the Website.

Information regarding the availability of Products is provided at the time of order.
Any order placed with the Company implies unconditional acceptance of the provisions of the GTC.

ARTICLE 2 – THE PRODUCTS

The Company sells second-hand and refurbished Products.

The Products sold by the Company are subject to specific testing and treatment according to their type.

The Company informs the Client that the Products have undergone a "hard reset" data wipe before being put on sale, meaning that the Company performs a complete reset of the Product, deleting all existing data from a previous owner.

The list of tests and treatments performed by type of Products is available upon request from the Company, whose contact details are specified in Article 10 of the GTC.

ARTICLE 3 – ORDER

It is the Client's responsibility to select the Product they wish to order on the website and to make the purchase.

The order steps are those specified on the website.

The sale will only be considered definitive after the Client has received a confirmation of acceptance of the order from the Company via email, and after the Company has collected the full price.

ARTICLE 4 – PRICE

The Products are provided at the current price indicated on the Website.

Prices are expressed and payable in Euros (€), net, all taxes included (TTC), firm and non-revisable.

Prices take into account any applicable discounts on the day of the order.

The prices of the Products do not include delivery costs (shipping, packaging, and preparation of the package according to the current amounts). The amount of delivery fees will be specified before validation of the order.

The Company reserves the right to modify prices at any time, without notice, but the Products will be invoiced to the Client at the price in effect at the time of purchase.

ARTICLE 5 – PAYMENT

5.1 Cash Payment
The price can be paid in cash at the time of the order by the Client.

5.2 Deferred Payment in 4 Installments by Credit Card
For purchases between €30 and €2000, the Company offers its Clients a credit service via Paypal for the payment of their purchases, subject to eligibility.

The Client's acceptance of the GTC or the credit contract proposed by Paypal is a prerequisite for using this service.

In the event of refusal of credit by Paypal, the order may be canceled.
Any termination of the GTC between the Client and the Company will result in the termination of the GTC or the credit contract between Paypal and the Client.

Payment in installments is available through our partner Paypal, which also ensures payment security. All payments are protected by the 3D Secure system.

Fees
Paypal does not apply any fees for providing the 4X Payment.

Paypal is the manager of remote payment and issues an electronic certificate serving as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 and following of the Civil Code.

Credit obligates you and must be repaid. Be sure to check your repayment capabilities before committing.

Termination
Any termination of the GTC between the Company and the Client results in the termination of the GTC between Paypal and the Client.

If the Client wishes to pay for their order in installments, they accept the general and specific conditions of Paypal available at: https://www.paypal.com/fr/webapps/mpp/campaigns/pay-in-4x-full.

ARTICLE 6 – DELIVERY

6.1 Delivery of Products
The Products purchased by the Client are deliverable in several countries of the European Union, to the delivery address indicated by the Client at the time of the Order.

In France, we offer the following delivery services:

  • Mondial Relay: Delivery to a relay point with tracking within 3 to 5 business days (the most economical option).
  • Colissimo without signature: Home delivery with tracking within 48 to 72 business hours.
  • Colissimo with signature: Home delivery with tracking within 48 to 72 business hours, requiring a signature.
  • Chronopost Express: Home delivery within 24 to 48 business hours with tracking and signature (the fastest option).

For the rest of the European Union, the following services are preferred:

  • Chronopost Classic: Delivery within 3 to 5 business days with tracking and signature (the most economical option).
  • Chronopost Express: Delivery within 48 to 72 business hours with tracking and signature (the fastest option).

Unless otherwise stated, the Company will send the Products within a maximum of 72 business hours after receipt of payment. This timeframe may be suspended by right in the event of an occurrence beyond the Company's control that delays delivery.

6.2 Verification of Packages
It is the Client's responsibility to verify the condition of the package and the ordered Products upon receipt, that is to say, at the time of delivery of the package by the Carrier or when picking it up at a relay point.

In case of damaged or non-compliant package or Product noted upon receipt, the Client must either (i) refuse to sign the delivery note and refuse the Product, or (ii) sign the delivery note while stating their reservations and accept the Product. In the latter case (ii), the Client must keep the damaged package for 15 days and inform the Company of the situation in writing.

6.3 Delivery Times
The delivery times indicated are estimates based on the delivery service chosen and do not include weekends or public holidays. The Company shall not be held responsible for delays due to force majeure or other circumstances beyond its control, such as strikes or extreme weather conditions.

Delivery times will only be taken into account from the date of payment of the order.

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with the provisions of Articles L.221-18 and following of the Consumer Code, the Client has a period of fourteen (14) days from the date of receipt of their Products to exercise their right of withdrawal without having to justify their decision or to incur any penalty.

To exercise their right of withdrawal, the Client must inform the Company of their decision by means of an unambiguous declaration sent to the following address: RECONVERTEUR

The Client can also use the model form provided in Appendix 1 of the GTC.

The Client must return the Products within fourteen (14) days following the notification of withdrawal, in their original packaging, with all accessories and documentation.
Products that are damaged or incomplete cannot be returned and will not be accepted.

The return of Products is the responsibility of the Client.

If the right of withdrawal is exercised under the conditions stated above, the Company will reimburse the Client for the total amount paid for the Products (including delivery costs) within a maximum period of fourteen (14) days from receipt of the Products returned, using the same payment method used for the initial transaction, unless the Client expressly agrees to a different payment method.

ARTICLE 8 – WARRANTIES

8.1 Legal Warranty
The Client benefits from the legal guarantee of conformity (Articles L.217-4 and following of the Consumer Code) and the legal warranty against hidden defects (Articles 1641 and following of the Civil Code).

In the event of non-conformity of a Product, the Client may choose between a refund or an exchange.

In the event of hidden defects, the Client may choose to return the Product in order to obtain a refund.

8.2 Commercial Warranty
In addition to the legal warranties, the Company offers a commercial warranty of six months from the date of delivery of the Product, covering all manufacturing defects or significant non-conformities of the Products sold.
This warranty does not cover wear and tear due to normal use, damage resulting from negligence or accidents, or damage due to improper use of the Products.

ARTICLE 9 – PERSONAL DATA

The Client's personal data is collected by the Company to manage the sales, and the execution of orders, and to fulfill legal obligations.

The Client's data may be communicated to the Company's partners for the execution of services necessary for the order.

In accordance with the regulations in force, the Client has the right to access, rectify, and delete their personal data, as well as the right to object to their processing.

To exercise these rights, the Client must contact the Company at the address specified in Article 10 of the GTC.

ARTICLE 11 – DISPUTE RESOLUTION

These GTC are governed by French law.
In the event of a dispute between the Client and the Company, the parties agree to seek an amicable solution before any judicial action.

If an amicable solution cannot be reached, the Client may initiate a procedure before the competent court.

The Client also has the option of resorting to a consumer mediator in the event of a dispute.

ARTICLE 12 – PERSONAL DATA AND COOKIES

When browsing the Site, personal data concerning the Customer is collected by the Company in accordance with the GDPR. The Customer can exercise their right to consult, modify, or delete personal data concerning them by sending a request via email to: contact@reconverteur.com
